La evaluación de todas las Entradas elegibles y determinación de los Participantes ganadores estará encomendada a un Jurado (el “Jurado”).(i) El Jurado se integrará por 4 (cuatro) miembros que determinará Nobox, que en todo caso, deberán ser personas que trabajen en el departamento creativo de Nobox.(ii) Las resoluciones del Jurado se determinarán por votación simple de todos los miembros durante el Período de Participación del Concurso, atendiendo los criterios de evaluación precisados en el Término Cuarto siguiente, de las presentes Bases Legales.(iii) Las resoluciones emitidas por el Jurado serán inapelables por cualquier Participante. | THIRD. | La participación constituye el acuerdo total e incondicional del Participante con estas Bases Legales y con las decisiones del Patrocinador y/o Administrador, que son definitivas y vinculantes en todos los asuntos relacionados con el Concurso. Ganar un premio depende de que se cumplan todos los requisitos establecidos en este documento. El Patrocinador y/o Administrador se reserva el derecho de verificar la elegibilidad de los Ganadores. | Participation constitutes Entrant’s full and unconditional agreement to these Legal Terms and to Sponsor’s and/or Administrator’s decisions, which are final and binding in all matters related to the Contest. | No son elegibles para participar en el Concurso los empleados, funcionarios y/o directores de los Patrocinadores y/o Administradores, y/o de sus filiales, subsidiarias, agencias de publicidad, promoción o producción, así como los dependientes, cónyuge, hijos, hermanos y/o cualquier pariente en línea recta sin limitación de grado de los miembros del Jurado. | Are not eligible to participate in the Contest all employees, officers and/or directors of Sponsors and/or Administrators, and/or their affiliates, subsidiaries, advertising, promotion and/or production agencies, as well as dependents, spouse, children, siblings and/or any straight-line relative without limitation of the degree of the Jury members. |
| QUINTO. Notificación de los Ganadores. (i) El día 27 de Noviembre de 2020, el Administrador a través de su cuenta https://www.facebook.com/Latam.PlayStation/ de Facebook, publicará los nombres de los Ganadores mediante el post del Concurso. Dentro de las 24 (veinticuatro) horas posteriores a la publicación, el Administrador, a través de su cuenta en Facebook enviará un mensaje directo a los Ganadores solicitando su correo electrónico y sus datos generales, en el entendido que “datos generales” es aquella información que permita identificar a un Participante, tal como: nombre, fecha de nacimiento, país de residencia, género y número de teléfono. Los Ganadores deberán responder al Administrador el mensaje directo con la información solicitada dentro de 24 (veinticuatro) horas siguientes de haber recibido el mensaje directo. Con posterioridad a las 24 (veinticuatro) horas de haber recibido la respuesta al mensaje directo el Administrador enviará por correo electrónico a los Ganadores una Declaración de Elegibilidad y Liberación de Responsabilidad (la “Declaración”), solicitando a los Ganadores que completen, firmen y devuelvan la Declaración por correo electrónico dentro de los 48 (cuarenta y ocho) horas de ser notificado. El cumplimiento de este procedimiento (el “Procedimiento de Notificación”) es indispensable para que un Participante sea confirmado Ganador y pueda reclamar su premio.Los Ganadores estarán sujetos a la verificación del cumplimiento de las presentes Bases Legales por los Patrocinadores y/o Administradores cuyas decisiones son finales y vinculantes en todos los asuntos relacionados con el Concurso. | FIFTH. Winners Notification. On November 27th, 2020, the Administrator through his Facebook account https://www.facebook.com/Latam.PlayStation, will publish the names of the Winners through the Contest post. Within 24 (twenty-four) hours after the Administrator posts the Winner´s names, through his account on Facebook, the Administrator will send a direct message to the Winners requesting their email and their general data, on the understanding that “general data” is any information that allows to identify a Participant, such as: name, date of birth, country of residence, gender and cell phone number. Winners must answer to the Administrator direct message with the requested information within 24 (twenty-four) hours after receiving the direct message. After 24 (twenty-four) hours after the receiving the response to the direct message, the Administrator will send an email attaching the Winners a Statement of Eligibility and Release of Responsibility (the “Statement”) requesting the Winners to complete, sign and return the Statement by email within 48 (forty-eight) hours of being notified. Compliance with this procedure (the “Notification Procedure”) is essential for a Participant to be confirmed as a Winner and to claim the prize. Winners will be subject to verification of compliance with these Legal Bases by Sponsors and/or Administrators whose decisions are final and binding on all matters related to the Contest. |
| (ii) Si el posible Ganador no responde al mensaje directo dentro de las 24 (veinticuatro) horas posteriores a su recepción o, si no devuelve la Declaración firmada dentro de las 48 (cuarenta y ocho horas) de ser notificado por correo electrónico, el premio se tendrá por no aceptado, y deberá seleccionarse a un Ganador alternativo, el cual será elegido por el Jurado dentro de las 24 (veinticuatro) horas siguientes de haber concluido el periodo de respuesta. El Jurado evaluará conforme al mismo criterio utilizado para elegir a los demás Participantes Ganadores, descrito en el Término Cuarto de las presentes Bases Legales. | (iv) Cualquier Premio No Aceptado por el Ganador alternativo dentro de las 24 (veinticuatro) horas posteriores a la comunicación mediante el Procedimiento de Notificación descrito en el Inciso (i) anterior, se considerará perdido y se descartará a discreción exclusiva del Jurado. Los premios se otorgarán siempre que se reciba una cantidad suficiente de Entradas elegibles durante el Período de Participación del Concurso. | (iv) Any Prize Not Accepted by the alternate Winner within 24 (twenty-four) hours after communication through the Notification Procedure described in section (i) above, shall be considered lost and the Prize shall be discarded at the sole discretion of the Jury. | (v) Los Patrocinadores y/o Administradores se reservan el derecho de cancelar, suspender y/o modificar el Concurso, o cualquier parte del mismo, si algún fraude, fallas técnicas o cualquier otro factor fuera del control razonable de los Patrocinadores y/o Administradores, pudiere llegar a perjudicar la integridad, las Políticas o imagen de los Patrocinadores y/o Administradores; o el funcionamiento adecuado del Concurso, según lo determinen los Patrocinadores y/o Administradores a su entera discreción, y, en caso de cancelación, los Ganadores se determinarán como se describe en el Término Cuarto anterior entre todas las Entradas elegibles antes de la cancelación. | (v) The Sponsors and/or Administrators reserve the right to cancel, suspend and/or modify the Contest, or any part thereof, if any fraud, technical failures, or any other factor beyond the reasonable control of the Sponsors and/or Administrators, may harm the integrity, the Policies or image of the Sponsors and/or Administrators; or proper functioning of the Contest, as determined by the Sponsors and/or Administrators at their sole discretion and, in the event of cancellation, the Winners shall be determined as described in Term Fourth above among all the eligible Entries prior to cancellation. |
| (vi) Los Patrocinadores y/o Administradores se reservan el derecho, a su entera discreción, de descalificar a cualquier Participante que considere que está intentando alterar o socavar el proceso de Entrada y/o el funcionamiento legítimo del Concurso; violar las presentes Bases Legales; o actuar de manera disruptiva o con la intención de molestar, abusar, amenazar o acosar a cualquier otra persona. Si, por cualquier motivo, Los Patrocinadores y/o Administradores no pueden ejecutar el concurso según lo planeado, Los Patrocinadores y/o Administradores pueden, a su entera discreción, anular cualquier Entrada sospechosa y modificar el Concurso o suspender el Concurso para abordar el impedimento y luego reanudar el Concurso en una manera que mejor se ajuste al espíritu de estas Bases Legales. | (vi) The Sponsors and/or Administrators reserve the right, in their sole discretion, to disqualify any Participant who they considered is attempting to disrupt or undermine the Entry process and/or the legitimate operation of the Contest; violate these Legal Terms; or act in a disruptive manner or with the intent to annoy, abuse, threaten or harass any other person. If, for any reason, Sponsors and/or Administrators are unable to execute the Contest as planned, Sponsors and/or Administrators may, in their sole discretion, cancel any suspicious Entries and modify and/or suspend the Contest to address the impediment and then resume the Contest in a manner that best conforms to the spirit of these Legal Terms. |

| El valor total de todos los Premios es de $2,096 USD (dos mil noventa y seis dólares americanos). Los Ganadores no pueden sustituir, asignar o transferir los Premios, ni canjearlos por dinero en efectivo. Los Premios tienen carácter de personalísimos, si el Ganador decide no aceptar el Premio, éste se perderá automáticamente, quedando sin derecho a compensación de ningún tipo. | The total value of all the Prizes is $2,0960 USD (two thousand and ninety-six american dollars). | Las controversias, disputas, reclamaciones, desacuerdos o desavenencias surgidas con motivo de las presentes Bases Legales o que guarden relación con las mismas (la “Disputa”), podrán resolverse mediante mediación, dentro de los 30 (treinta) días naturales siguientes a la recepción de la notificación de Disputa por cualquiera de los Participantes. | Controversies, disputes, claims, or disagreements arising from or related to these Legal Terms (the “Dispute”), may be resolved by mediation, within the next 30 (thirty) calendar days following the reception of the Dispute notification by any of the Participants. |
| En caso de que los Patrocinadores y/o Administradores y el Participante no resolvieren la Disputa dentro del mencionado período de 30 (treinta) días naturales, entonces deberán, dentro de un plazo adicional de 10 (diez) días naturales, nombrar mutuamente a un mediador que los auxilie a resolver la Disputa. Los honorarios y gastos de cualquier mediador designado deberán cubrirse por los Participantes. Si habiéndose nombrado un mediador en el plazo arriba establecido y este mediador no logra resolver la Disputa dentro de un plazo de 60 (sesenta) días naturales a partir de su nombramiento, entonces cualquiera de las partes podrá recurrir al arbitraje; las Disputas serán resueltas definitivamente de acuerdo con el Reglamento de Arbitraje de la Cámara de Comercio Internacional vigente al Periodo de Participación del Concurso por tres árbitros nombrados conforme a este Reglamento. La sede del arbitraje será la Ciudad de México.
